This agreement constitutes a binding legal contract between you (the "User") and Daniel Hernández (the "Developer" or "We") regarding the use of the mobile application Tour App – AI Tour Guide. By downloading, installing, or using the application, you agree to comply with all the terms described herein.

1. Description of the Service and Use of Artificial Intelligence

Tour App – AI Tour Guide is a technological tool that generates personalized tour itineraries, routes, and audio guides in real time based on the device's location and the preferences indicated by the user.

By using this service, the User accepts and understands that:

• AI-Generated Content: All tour narratives and audible stories are dynamically generated using Artificial Intelligence models. Specifically:
  • Google Gemini: generates the narrative texts (stories, place descriptions, city welcomes).
  • OpenAI TTS (Text-to-Speech): converts those texts into high-fidelity voice (available exclusively in the Premium plan).
• Historical and Geographical Inaccuracies: Generative AI technologies may present historical inaccuracies, chronological errors, or make up facts about people, monuments, or businesses ("AI hallucinations"). The Developer assumes no responsibility regarding the absolute veracity of the generated tourism content.
• Attractions and Schedules: The application does not know in real time the business hours, the renovation status of public monuments, local holidays, or venue closures. The User is responsible for validating access through official channels.

2. Background Location and Device Usage

In order to offer a comfortable and "hands-free" guided tour (allowing you to walk with your phone locked in your pocket or with the screen turned off and receive narratives automatically), the app requires continuous access to your precise background location.

• Battery Consumption: Continuous use of GPS systems in the background and real-time map rendering can significantly increase the battery discharge rate of your mobile device. The User accepts this consumption as a necessary part of the operational experience.
• Road Safety Responsibility: The User must pay extreme attention to their real environment while walking and listening to the guides. Use of the app is prohibited if it distracts you from vehicular traffic, road signs, or endangers your physical integrity. The Developer will not be held responsible for falls, pedestrian accidents, device thefts, or traffic incidents occurring during the use of the service.

3. Subscription Plans, Payments, and Billing

The app offers limited free access and auto-renewing subscription plans:

• Basic Plan: access to guided tours with native device text-to-speech voices (the quality of these voices depends on your device's model and operating system). Subject to the Fair Usage Policy described in Section 4.
• Premium Plan: access to guided tours with high-fidelity Artificial Intelligence voices generated by OpenAI (TTS), in addition to all features of the Basic plan. Subject to the Fair Usage Policy described in Section 4.

Both plans are offered in monthly or annual frequencies. Current rates are detailed on the app's integrated paywall.

Free Regional Access

In certain countries or regions, the Developer may offer free and unrestricted access to tour generation, without needing a subscription. In such cases, access will be limited to native device text-to-speech voices. The regions covered by this exception may be modified at any time via remote configuration updates of the app.

Payment Processing

All financial charges are securely processed and managed through Apple StoreKit / In-App Purchase or Google Play Billing, managed via the technical platform RevenueCat. The Developer never collects, stores, or has direct access to the user's credit card details or payment credentials.

Automatic Renewal

By purchasing a monthly or annual subscription, you agree that the charge will automatically renew at the end of each billing cycle. To avoid unwanted charges, you must cancel your subscription at least 24 hours before the end of the current billing period.

Cancellations and Refunds

You can cancel automatic renewal at any time from the subscription settings of your Apple ID or Google Play account. The Developer does not have the technical or legal ability to process refunds directly. Any refund request must be processed directly with Apple or Google in accordance with their respective policies.

4. Fair Usage Policy

In order to ensure the technical stability of the service, avoid saturation of our servers, and mitigate the high direct costs of Third-Party APIs (in particular, OpenAI TTS high-fidelity voice synthesis services and Google Maps/Gemini queries), access to tours and narratives is regulated under a principle of reasonable, exclusively personal, and non-commercial use:

Active Monthly Limits

The following limits apply per calendar month (resetting on the 1st of each month):

• Basic Plan: up to 100 generated tours per calendar month. Upon reaching this limit, it will not be possible to start new tours until the beginning of the next month. The option to purchase the Premium plan to continue will be offered.
• Premium Plan: generation of audio with AI voices (OpenAI TTS) limited to 30 narratives per calendar month. Upon exceeding this limit, the app will continue to function normally but will automatically switch to native device voices (operating system Text-to-Speech) until the counter resets the following month. Access to tour generation will not be interrupted.

Note: These limits may be adjusted at any time via remote configuration of the app in order to maintain the quality and stability of the service.

Non-Human / Automated Use

Use of the app via emulators, automation scripts, scrapers, or any mechanism that generates automatic massive requests to the backend is strictly prohibited.

Commercial Exploitation

It is not permitted to use the narratives generated by the application to directly generate profit, conduct commercial group guided tours, resell the audio, or conduct public broadcasts without prior written authorization from the Developer.

5. Intellectual Property

All intellectual property rights associated with the user interface, app source code, backend logic, AI system prompts, databases, logos, and the trademark Tour App – AI Tour Guide / Kuvit belong exclusively to Daniel Hernández. Use of the app grants you a personal, non-exclusive, revocable, and non-transferable license solely to experience the tours for personal use.

6. Availability and Technical Disclaimers

The app inherently depends on the availability of services provided by third parties (Google Cloud APIs, OpenAI, RevenueCat, local cellular services, and GPS). We do not guarantee that the service will function uninterruptedly or error-free at all times and locations. The Developer is not responsible for system outages in the middle of a trip or for lack of cellular coverage in rural or historical areas.

7. Modifications to the Terms

We reserve the right to modify these Terms and Conditions at any time. The date of the last update will be indicated in the header of this page. Continued use of the app after the publication of changes will imply your acceptance of the new terms.

8. Jurisdiction and Applicable Law

These terms are governed by and construed in accordance with the laws in force in the Republic of Chile. Any dispute, controversy, or legal claim arising from the use of the app shall be resolved before the competent courts of justice of Santiago de Chile.
